Weather Direct Terms of Service

1. Important Weather and Safety Disclaimer

Weather Direct is provided for general informational purposes only.

Weather conditions can change rapidly, forecasts may be inaccurate, alerts may be delayed, data may be incomplete, and technical systems may fail. Weather Direct should not be your only source of weather, emergency, safety, evacuation, aviation, marine, travel, wildfire, flood, storm, hurricane, tornado, severe weather, heat, cold, lightning, or life-safety information.

You are solely responsible for monitoring official sources, local authorities, emergency management agencies, NOAA, the National Weather Service, the National Hurricane Center, law enforcement, fire departments, public safety agencies, and other appropriate sources before making safety-related decisions.

Do not rely solely on Weather Direct during emergencies.

If you are in immediate danger, call emergency services or follow the instructions of local authorities.

2. No Emergency Service

Weather Direct is not an emergency alert system, emergency dispatch system, public warning system, rescue service, safety service, or substitute for official emergency communications.

We do not guarantee that you will receive any alert, notification, warning, watch, advisory, statement, update, forecast, tropical notice, radar image, or severe-weather information in time to act.

Push notifications, in-app alerts, background refreshes, location updates, and network-dependent services may be delayed, blocked, disabled, throttled, unavailable, or inaccurate due to device settings, operating system limits, network conditions, third-party services, user permissions, battery settings, location accuracy, server availability, API availability, or other factors outside our control.

You agree that Weather Direct is not responsible for any harm, injury, loss, death, property damage, business interruption, missed warning, delayed warning, inaccurate forecast, incomplete alert, failed notification, failed location lookup, or other damages resulting from your use of or reliance on Weather Direct.

3. Weather Data and Third-Party Sources

Weather Direct may display, process, summarize, reformat, cache, or organize weather-related data from third-party or public sources, which may include sources such as NOAA, the National Weather Service, the National Hurricane Center, other government agencies, radar providers, map providers, geolocation providers, operating-system services, and other weather data services.

Weather Direct is not affiliated with, sponsored by, endorsed by, or officially connected to NOAA, the National Weather Service, the National Hurricane Center, the United States government, or any other third-party data provider unless expressly stated in writing.

Third-party data may be delayed, incomplete, unavailable, inaccurate, changed, discontinued, restricted, reformatted, or interpreted differently by Weather Direct. We do not control third-party data sources and are not responsible for their accuracy, timeliness, reliability, availability, formatting, policies, outages, or changes.

You agree that all weather data, forecasts, alerts, maps, radar, tropical information, and related content are provided for informational purposes only and are used at your sole risk.

4. No Professional Advice

Weather Direct does not provide professional meteorological, emergency management, legal, engineering, aviation, marine, agricultural, construction, insurance, medical, travel, or safety advice.

You should consult qualified professionals, official agencies, and local authorities before making decisions that may affect life, safety, property, travel, operations, business, crops, animals, vehicles, aircraft, boats, buildings, or infrastructure.

5. Assumption of Risk

You understand and agree that weather is inherently dangerous, unpredictable, and capable of causing serious injury, death, property damage, financial loss, and other harm.

By using Weather Direct, you knowingly and voluntarily assume all risks associated with:

• Weather events and environmental conditions;
• Reliance on forecasts, alerts, warnings, advisories, statements, radar, maps, or weather data;
• Delayed, missing, incorrect, incomplete, or unavailable information;
• Device, network, software, server, location, notification, or third-party service failures;
• Decisions you make based on Weather Direct;
• Any failure to consult official sources or local authorities.

6. User Responsibility

You agree to use Weather Direct responsibly and only as one informational source among others.

You agree that you will:

• Verify important weather and safety information through official sources;
• Follow instructions from local, state, federal, tribal, territorial, or other public authorities;
• Maintain other means of receiving emergency information;
• Ensure your device settings allow alerts, location access, notifications, and background activity where desired;
• Not use Weather Direct as your sole source of emergency information;
• Not use Weather Direct for aviation, marine navigation, rescue operations, hazardous operations, commercial safety systems, critical infrastructure, or other high-risk activities where failure could lead to death, injury, or serious loss.

7. High-Risk Use Prohibited

Weather Direct is not designed, certified, or intended for use in high-risk environments, including but not limited to:

• Aviation;
• Marine navigation;
• Emergency response;
• Disaster response;
• Military operations;
• Search and rescue;
• Medical decision-making;
• Industrial safety systems;
• Construction safety systems;
• Critical infrastructure;
• Transportation dispatch;
• Evacuation management;
• Wildfire response;
• Flood control;
• Any use where inaccurate, delayed, or unavailable information could result in death, personal injury, property damage, or environmental harm.

8. Location Services

Weather Direct may use your device location, manually entered locations, saved locations, or approximate location information to display weather conditions and alerts.

Location data may be inaccurate, unavailable, delayed, or imprecise. Weather Direct may identify the wrong forecast zone, alert zone, city, county, marine zone, radar region, or weather office. You are responsible for verifying that the location shown in Weather Direct is correct.

We are not responsible for any harm caused by incorrect, delayed, missing, or unavailable location information.

9. Alerts, Watches, Warnings, Advisories, and Statements

Weather Direct may display or notify you of weather alerts, watches, warnings, advisories, special weather statements, tropical products, severe weather products, hydrological products, or other weather-related notices.

We do not guarantee that Weather Direct will display all available alerts or that alerts will be delivered in real time. Alerts may be delayed, missed, duplicated, expired, mislabeled, truncated, misparsed, incorrectly prioritized, or unavailable.

You should always consult official alerting sources, local authorities, NOAA Weather Radio, emergency management agencies, and other official channels during severe or dangerous weather.

10. Tropical Weather and Hurricane Information

Weather Direct may display tropical cyclone information, hurricane information, storm tracks, forecast cones, advisories, discussions, watches, warnings, rainfall outlooks, storm surge information, wind probabilities, or other tropical products.

Tropical cyclone forecasts are uncertain and can change rapidly. Forecast cones do not represent all possible impacts. Dangerous conditions may occur outside displayed forecast areas.

You are solely responsible for following official evacuation orders, local emergency instructions, and guidance from emergency management authorities.

11. Radar, Maps, and Visual Displays

Radar, maps, overlays, icons, forecast graphics, weather backgrounds, and visual displays in Weather Direct may be simplified, delayed, cached, stylized, approximated, or interpreted for readability.

Visual displays should not be used as precise, real-time measurements of danger, precipitation, storm movement, storm intensity, flooding, lightning, wind, hail, tornado risk, wildfire risk, road safety, or other hazards.

Map boundaries, alert polygons, radar layers, and location markers may be inaccurate or delayed.

12. App Availability

Weather Direct may be unavailable, interrupted, delayed, limited, modified, suspended, or discontinued at any time without notice.

We do not guarantee uninterrupted access, real-time performance, data availability, server availability, API availability, notification delivery, location accuracy, or compatibility with any device, operating system, app store, carrier, network, or third-party service.

13. Updates and Changes

We may update, modify, add, remove, suspend, or discontinue any part of Weather Direct at any time, including features, data sources, alerts, maps, radar, notifications, subscription options, pricing, and supported locations.

We may update these Terms from time to time. Changes become effective when posted, displayed, or otherwise made available. Your continued use of Weather Direct after changes become effective means you accept the updated Terms.

14. Purchases, Subscriptions, and Payments

Weather Direct is currently offered as a free app and does not include advertising, in-app subscriptions, or required paid accounts in its initial release.

If Weather Direct adds paid features, subscriptions, one-time purchases, donations, or other monetization options in the future, those options will be disclosed before any payment is required and may be processed through Apple, Google, or another applicable platform. Any future purchase may also be subject to the terms, refund policies, cancellation rules, and billing practices of the applicable app store or payment platform.

Unless required by law or by the applicable app store, future payments, if any, may be non-refundable.

15. User Content and Feedback

If you submit feedback, suggestions, ideas, bug reports, feature requests, reviews, comments, screenshots, or other content to us, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable, transferable license to use, copy, modify, publish, distribute, display, and incorporate that content for any lawful purpose, including improving Weather Direct, without compensation to you.

You agree not to submit content that is unlawful, abusive, defamatory, infringing, misleading, harmful, or violates the rights of others.

16. Intellectual Property

Weather Direct, including its design, interface, software, graphics, branding, text, icons, layout, features, trade names, logos, and original content, is owned by us or our licensors and is protected by applicable intellectual property laws.

You may not copy, modify, reverse engineer, distribute, sell, lease, sublicense, scrape, interfere with, or create derivative works from Weather Direct except as permitted by law or expressly authorized by us in writing.

Third-party data, trademarks, names, and content remain the property of their respective owners.

Use of NOAA, National Weather Service, National Hurricane Center, or other third-party names does not imply endorsement, sponsorship, or affiliation.

17. Acceptable Use

You agree not to:

• Use Weather Direct unlawfully;
• Interfere with, damage, overload, reverse engineer, or disrupt Weather Direct;
• Attempt to gain unauthorized access to our systems;
• Use Weather Direct to create a competing product by scraping, copying, harvesting, or bulk extracting content;
• Misrepresent Weather Direct data as official emergency instructions;
• Remove or obscure source attributions, disclaimers, or notices;
• Use Weather Direct in a way that could harm others;
• Violate any applicable law, regulation, third-party term, or platform rule.

18. Privacy

Your use of Weather Direct may involve location information, manually selected locations, app settings, local notification preferences, cached weather data, and other information described in our Privacy Policy.

Weather Direct is designed without Weather Direct accounts, advertising SDKs, analytics SDKs, tracking SDKs, Firebase, CloudKit sync, or a Weather Direct backend in its initial release. Please review our Privacy Policy to understand how information is used, stored locally, and sent directly from your device to public weather, geocoding, radar, mapping, app-store, or operating-system services when needed for app functionality.

If these Terms conflict with the Privacy Policy regarding privacy practices, the Privacy Policy controls for that issue.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEATHER DIRECT IS PROVIDED ON AN AS IS, AS AVAILABLE, AND WITH ALL FAULTS BASIS.

WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, TIMELINESS, RELIABILITY, AVAILABILITY, SECURITY, PERFORMANCE, COMPATIBILITY, AND THAT WEATHER DIRECT WILL BE ERROR-FREE OR UNINTERRUPTED.

WE DO NOT WARRANT THAT:

• WEATHER DIRECT WILL BE ACCURATE, COMPLETE, TIMELY, RELIABLE, OR AVAILABLE;
• ALERTS, WARNINGS, WATCHES, ADVISORIES, OR NOTIFICATIONS WILL BE DELIVERED;
• WEATHER DATA WILL BE CURRENT, CORRECT, OR COMPLETE;
• LOCATION SERVICES WILL IDENTIFY THE CORRECT LOCATION OR ALERT AREA;
• RADAR, MAPS, OR VISUAL DISPLAYS WILL BE ACCURATE OR REAL-TIME;
• DEFECTS OR ERRORS WILL BE CORRECTED;
• WEATHER DIRECT WILL MEET YOUR NEEDS;
• WEATHER DIRECT WILL PREVENT HARM, INJURY, DEATH, DAMAGE, OR LOSS.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEATHER DIRECT, ITS OWNERS, OPERATORS, DEVELOPERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, DATA PROVIDERS, SERVICE PROVIDERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, BUSINESS, PROPERTY, DEVICE FUNCTIONALITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, WEATHER DIRECT.

THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO WEATHER DIRECT OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID TO USE WEATHER DIRECT IN THE THREE MONTHS BEFORE THE CLAIM AROSE; OR
2. TEN U.S. DOLLARS ($10.00).

21. Hold Harmless and Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, release, and hold harmless Weather Direct, its owners, operators, developers, affiliates, officers, directors, employees, contractors, agents, licensors, data providers, service providers, and partners from and against any and all claims, demands, actions, losses, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your access to or use of Weather Direct;
• Your reliance on Weather Direct;
• Your failure to consult official sources or local authorities;
• Your actions or inactions during weather events;
• Your violation of these Terms;
• Your violation of any law or third-party right;
• Your misuse of weather data, alerts, forecasts, maps, radar, or notifications;
• Your use of Weather Direct for high-risk, emergency, aviation, marine, commercial safety, or prohibited purposes;
• Any injury, death, property damage, financial loss, or other harm allegedly connected to your use of Weather Direct.

22. Release

To the maximum extent permitted by law, you release Weather Direct, its owners, operators, developers, affiliates, officers, directors, employees, contractors, agents, licensors, data providers, service providers, and partners from any and all claims, liabilities, damages, losses, injuries, deaths, costs, and expenses arising out of or related to your use of Weather Direct, your reliance on Weather Direct, weather events, emergency decisions, missed alerts, delayed alerts, inaccurate information, incomplete information, unavailable information, or your failure to use official sources.

23. Third-Party Services

Weather Direct may depend on third-party or public services, platforms, APIs, data providers, app stores, operating systems, map services, geolocation services, notification systems, hosting providers, and public weather sources.

We are not responsible for third-party or public services, their data, their availability, their terms, their privacy practices, their errors, their outages, or their changes.

Your use of third-party services may be subject to additional terms and policies.

24. App Store Terms

If you download Weather Direct through an app store or platform, your use may also be subject to that platform's terms, rules, and policies.

The app store provider is not responsible for Weather Direct, its content, maintenance, support, warranties, claims, or damages, except as required by applicable law or platform rules.

25. Termination

We may suspend, restrict, or terminate your access to Weather Direct at any time if we believe you violated these Terms, misused the App, created risk, violated law, or harmed Weather Direct or others.

You may stop using Weather Direct at any time.

Sections intended to survive termination will survive, including disclaimers, limitation of liability, indemnification, release, intellectual property, governing law, and dispute resolution.

26. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles, unless otherwise required by applicable law.

27. Dispute Resolution

Before filing a claim, you agree to first contact us and attempt to resolve the dispute informally.

If a dispute cannot be resolved informally, the dispute will be handled in the courts located in Washington County, Arkansas, unless applicable law requires another venue.

You and Weather Direct agree to bring claims only in your or our individual capacity and not as a plaintiff or class member in any class action, collective action, representative action, or private attorney general action, to the maximum extent permitted by law.

28. Severability

If any part of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not permitted.

29. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

30. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented in Weather Direct, form the entire agreement between you and us regarding Weather Direct.
